Making A Personal Injury Compensation Claim After An Accident. What To Consider

Wendy Wayne

If you have been injured in an accident through no fault of your own, below you will find some things to consider regarding road traffic accident claims, making a claim against an employer and accidents in public places to help you with your accident claim.

Road traffic accident claims

If you have been injured in a road traffic accident, the most important consideration you should have is that unless there is evidence such as video footage proving your version of events, what your claim will boil down to is your word against the defendant’s. Regarding this, it can prove invaluable to collect witness statements or the details of witnesses during or after your accident, so that they can substantiate your claim for you.

Another thing to consider is that insurance companies are notoriously slow at processing personal injury claims. In fact, it can take months to get a response. This is because they have their own investigative processes to follow.

Making a claim against an employer

If you have suffered an injury at work, it is important to remember that your employer has a legal duty to protect you at work. They must take reasonable measures to ensure your health, safety and wellbeing at work. If it can be proven that your employer failed in their legal duty to protect you, then you will have a strong workplace accident claim.

It is also important to remember that it is illegal for an employer to punish an employee directly or indirectly for making a claim. So all things considered, you should be able to return to work as normal once you recover from your injuries. However, this is no guarantee that you will not be punished. If you do feel that you are being treated unfairly by an employer during your claim, tell your lawyer so that they can deal with it on your behalf.

Accidents in public places

If you have injured yourself in a public place, then there’s a good chance that you will be able to make a claim with the local council or another local authority. For example, if you tripped over a pothole on a walkway, you would have a strong claim for compensation with the local council. Or, if you slipped on some steps that had inadequate foot grip areas, then you could make a claim with the authority responsible for their maintenance.

Under the circumstances, you should seek legal advice from a law firm specialising in such accidents, such as to get valuable legal advice. A lawyer within a reputable law firm will be able to tell you who your claim will likely be against.
